VENUE, JURISDICTION AND SERVICE OF PROCESS. Any dispute arising

competent jurisdiction in Orange County, California and the parties
agree to submit to the jurisdiction of the aforesaid court as the
exclusive tribunal for the resolution of disputes between them. J.D.
Research, Inc. makes no representation that materials in this
site are appropriate or available for use in other locations. If you
access this site from outside the United States, be advised this site
may contain references to products and services that are not
available or are prohibited in your country.
ARBITRATION
Any
dispute or claim arising out of or relating in any way to your use of
this website, to any purchases made through this website, or to the
sale of any products sold or distributed by J.D. Research, Inc, will
be resolved by binding arbitration, rather than in court, except that
you may assert claims in small claims court if your claims qualify.
The Federal Arbitration Act and federal arbitration law apply to this
agreement to arbitrate.
There is no judge or jury in arbitration and court review of an arbitration award is very limited. The scope of discovery is more limited in arbitration than in court. However, an arbitrator can award on an individual basis the same damages and relief as a court (including injunctive and declaratory relief or statutory damages), and must follow the terms of these Terms of Use as a court would.
To
begin an arbitration proceeding, you must send a letter requesting
arbitration and describing your claim to Legal

N. Glassell St. #1, Orange, CA 92867, USA. The arbitration will be
handled by the Superior Court of California, County of Orange,
Alternative Dispute Resolution (ADR). Payment of all filing,
administration and arbitrator fees will be governed by the Court.
We each agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated or representative action. We each hereby waive our right to participate in any class action, whether in court or arbitration. If for any reason a claim proceeds in court rather than in arbitration we each waive any right to a jury trial.
